Wat can I do when the government makes a mistake on my disability and decides 5 yrs later they were mistaken and hit me with a $50,000 overpayment and takes 1000 a month of my cheque and now have loans I cant pay insurance I cant afford if I was married to them they’d owe me .noe im screwed and my credit rating is down to a respectable 400 lol. Im a a single father and im barley making ends meet . Is there anything I can do besides take it dry in the ass I know wat I want to do but my son needs a dad that isnt doing a life bit.. this site is confusing and im not sure where I should be asking this question

Sorry to read you are going through a very rough time in life. I don’t know where you are located but I looked up Disability claims lawyer in Canada and there were a bunch that came up, even ones you don’t pay unless you win type lawyers.

The CRA has 3 years from the date of the original Notice of Assessment to reassess a return. At this point, you are protected by statute-barred limitations. Thank heavens.
The only thing that circumvents the 3-year limit is if the CRA believes there was misrepresentation, negligence, or fraud; a vague clerical error is not sufficient by itself. I am not here to judge or argue your circumstances or the actual case. Only to get you looking forward, because that is the only direction you have to go.
You have more than likely received a reassessment, and there is a 90-day window to file a Notice of Objection. Sounds like a good idea. I know you are already strapped for cash, so if you can’t afford a tax lawyer, I repeat, tax lawyer, not any lawyer. You need to utilize these resources.
A simple Google or GPT search for legal aid and resources in Alberta will give you various paths to explore. I would seek help in drafting the objection. If you are past that, I would still utilize the resources to find other options.
One thing I have learned is to be polite to anyone at the courthouse, CRA, or legal aid, own your shit, don’t give them your opinion or say it is their fault, and focus purely on the problem and how you can solve it. A worthy fighter always gives his enemy a golden bridge to retreat on.
Also, if you can make people laugh with some humour, think of anyone in a tough job who takes the brunt of the phone calls, and everyone tells them how horrible they are. Think about how I can win this person over to help me, and you’ll be ahead of the pack.
Your only weapon at this point is you, your mind, and how you handle yourself. Sounds easy, I know it’s not, and I wish you the best.
